By accessing or using our platform, creating an account, generating websites, or subscribing to our services, you agree to these Terms.

2. Service Description

We provide a Software-as-a-Service (SaaS) platform that allows users to generate, edit, publish, and export websites using AI.

The platform operates using subscription plans and a virtual credit system. Certain actions, including AI-powered website generation, page generation, and website export, consume credits. The required number of credits is displayed before the action is confirmed and may change over time.

Users may provide input including:

• website URLs
• links to third-party services (e.g., Google Maps)
• uploaded files (documents, PDFs, presentations)

Based on this input, the platform generates a website which users can modify and publish.

Websites are hosted by us and may be available via:

• a subdomain (e.g., <name>.zapsite.io)
• a custom domain configured by the user

3. Free Plan

We may provide a free plan that allows users to access limited functionality of the platform.

New users may receive a one-time allocation of promotional credits upon registration. These promotional credits are intended to allow users to generate an initial demonstration website and have no monetary value.

Promotional credits:

• cannot be transferred or exchanged for cash;
• are non-refundable;
• may expire or be revoked at our discretion;
• are subject to any usage limits displayed within the platform.

The features included in the Free Plan may change at any time.

4. Account

You are responsible for:

• maintaining the confidentiality of your account
• all activities under your account

We may suspend or terminate accounts for misuse, violation of these Terms, or non-payment.

5. User Content and Responsibility

You retain ownership of your content.

By using the service, you confirm that:

• you have the legal right to use all submitted content
• your content does not violate any laws or third-party rights

You are fully responsible for:

• all content submitted to the platform
• all content published on your website

We do not review or moderate content before publication.

6. Third-Party Content

The platform may process content from third-party sources (e.g., Google Maps or other services).

You are responsible for ensuring that:

• you have the right to use such content
• your use complies with the terms of those third-party services

We are not affiliated with or responsible for third-party platforms.

We do not guarantee availability, accuracy, or continued access to third-party content or integrations.

Features relying on third-party services may be modified or discontinued at any time without liability.

6A. Content Removal and Takedown

We reserve the right to remove, suspend, or restrict access to any website or content hosted on our platform at our sole discretion, including without prior notice, if we reasonably believe that such content:

• violates applicable laws
• infringes third-party rights (including intellectual property)
• is fraudulent, misleading, or harmful
• violates these Terms or our Acceptable Use Policy

We may also comply with legal requests or takedown notices from third parties.

We are not obligated to monitor or review content but may act when issues are brought to our attention.

7. Subscription, Credits and Payment

The platform offers both free and paid subscription plans.

Paid subscriptions may include recurring promotional credits that are added to the user's account at the beginning of each billing cycle.

Unused recurring promotional credits may expire at the end of the applicable billing cycle unless otherwise stated.

Users may also purchase additional credits separately from any subscription.

Purchased credits:

• may be used for AI generation, website export, or other credit-based features;
• remain associated with the user's account while the account remains active;
• have no cash value;
• cannot be transferred to another account.

Payments are processed through third-party payment providers such as Stripe.

We may modify subscription pricing, available plans, credit packages, credit pricing, or the number of credits required for particular actions at any time. Changes apply prospectively and do not affect completed purchases.

7a. Credit Usage

Credits are deducted immediately when a credit-based action is initiated.

The number of credits required for each action is displayed within the platform before confirmation.

Credits used for completed AI processing or website export cannot be restored solely because the generated output does not meet the user's expectations.

Where both promotional and purchased credits are available, promotional credits are consumed first.

8. Cancellation and Refunds

You may cancel your subscription at any time.

Cancellation takes effect at the end of the current billing period.

Subscription fees are non-refundable except where required by applicable law.

Purchased credits are non-refundable once they have been added to your account, except where required by applicable law.

Promotional credits have no monetary value and are never refundable.

If you are a consumer in the European Union, you acknowledge that the service consists of digital content and digital services supplied immediately upon purchase.

By using the platform, purchasing credits, or beginning AI generation, you expressly consent to immediate performance and acknowledge that your statutory right of withdrawal may be lost or limited to the extent permitted by applicable law.

9. Hosting and Availability

We host the generated websites.

We do not guarantee:

• uninterrupted availability
• uptime levels
• error-free operation

We may perform maintenance or updates that affect availability.

We may suspend or remove websites in case of:

• non-payment
• legal issues
• violation of these Terms

10. AI Limitations

The platform uses AI to generate content.

Generated output may:

• contain errors or inaccuracies
• be incomplete or outdated

You are responsible for reviewing all generated content before publishing.

11. Data Storage and Deletion

We store user data, uploaded content, and generated websites to provide the service.

You may request deletion of your account and data.

We are not responsible for data loss.

AI-generated actions consume credits regardless of whether the generated output meets your expectations. Users are responsible for reviewing generated content before publishing or exporting it.

12. Intellectual Property

You retain rights to your content.

We retain all rights to:

• the platform
• software
• AI systems

You are granted a limited, non-exclusive, non-transferable right to use the platform during your subscription.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• business losses
• SEO loss
• data loss
• third-party claims

Our total liability is limited to the amount paid by you in the last billing period.

We are not liable for any loss of unused promotional credits resulting from subscription cancellation, account termination, policy changes, or expiration in accordance with these Terms.

14. Termination

We may suspend or terminate access if:

• you violate these Terms
• payment fails
• misuse is detected

Upon termination:

• your website may be taken offline
• access to the platform may be revoked

15. Governing Law

These Terms are governed by the laws of Spain.
